  • "Debtor" refers to the individual or entity owing the debt subject to collection efforts
  • "Agreement" means the attorney-client engagement formed by accepting these Terms and executing a service agreement
  • "Website" refers to cllaimoora.live and all associated pages and services

2. Acceptance of Terms

By engaging our services, submitting consultation requests through our website, or otherwise communicating intent to retain our practice for debt recovery matters, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms establish the framework for our attorney-client relationship. Specific service details, fee structures, and case parameters will be outlined in individual service agreements executed upon engagement.

Only individuals or entities with legal capacity to enter binding agreements may engage our services. By proceeding, you represent that you possess such capacity and authority to bind any organization on whose behalf you act.

3.1 Scope of Legal Services

Claimora provides specialized legal representation for debt recovery and collection matters in Thailand. Our services encompass:

  • Pre-litigation demand letter preparation and debtor negotiation management
  • Civil litigation representation in Thai courts for debt collection actions
  • Post-judgment enforcement coordination including asset investigation and execution procedures
  • Legal consultation regarding collection strategies and procedural options

3.2 Service Limitations

Services are limited to debt collection representation. We do not provide:

  • General business legal counsel unrelated to debt recovery
  • Criminal prosecution or defense services
  • Tax advice or regulatory compliance counsel
  • Investment or financial planning guidance

3.3 Service Availability

Services are available to creditors seeking to collect commercial debts, promissory notes, and other legitimate obligations within Thailand's legal framework. Geographic coverage extends throughout Thailand with particular focus on Bangkok and surrounding provinces.

4. Client Responsibilities and Obligations

4.1 Documentation and Information

Clients must provide:

  • Complete and accurate documentation supporting debt claims including contracts, invoices, promissory notes, and correspondence
  • Truthful information about debt circumstances, debtor identity, and prior collection attempts
  • Timely responses to information requests necessary for case progression
  • Prompt notification of any debtor payments or settlement discussions occurring outside our representation

4.2 Cooperation and Communication

Clients agree to:

  • Respond to communication requests within reasonable timeframes
  • Attend court proceedings if required for testimony or evidence presentation
  • Maintain confidentiality of case strategy and privileged communications
  • Refrain from independent contact with debtors during active representation without prior consultation

4.3 Financial Obligations

Clients must pay agreed fees according to service agreement terms, reimburse approved out-of-pocket expenses including court filing fees and enforcement costs, and maintain current contact information for billing purposes.

5. Fees and Payment Terms

5.1 Fee Structure

Legal fees are structured based on service complexity and estimated work requirements. Pre-litigation demand services, civil litigation representation, and enforcement coordination each carry separate fee schedules as detailed in individual service agreements. Fee estimates provided during consultation reflect anticipated costs based on standard case progression.

5.2 Additional Costs

Clients are responsible for court filing fees calculated as percentage of claim amount, Legal Execution Department fees, skip-tracing service costs when required, document translation fees if necessary, and travel expenses for proceedings outside Bangkok metropolitan area. These costs are billed separately from attorney fees and require client approval before incurring.

5.3 Payment Terms

Payment schedules vary by service type. Pre-litigation services typically require payment upon engagement. Litigation matters may involve initial retainer with subsequent billing at procedural milestones. Enforcement services bill upon writ application with additional charges for recovered amounts. Specific payment terms are established in individual service agreements.

5.4 Currency and Methods

All fees quoted and billed in Thai Baht. Payment accepted via bank transfer to designated account. Late payments may incur interest charges as specified in service agreements.

6. Intellectual Property Rights

All materials created during representation including demand letters, court pleadings, legal memoranda, and strategic documents remain the intellectual property of Claimora. Clients receive limited license to use these materials for the specific debt collection matter but may not reproduce, distribute, or adapt them for other purposes without written permission.

Website content including text, graphics, logos, and design elements are protected by copyright and may not be used without authorization. Trademarks displayed on the website belong to their respective owners.

7. Disclaimers and Limitations

7.1 No Outcome Guarantees

Debt recovery involves inherent uncertainties. We cannot and do not guarantee specific outcomes, recovery amounts, or timeline completion. Success depends on multiple factors including debtor cooperation, asset availability, court decisions, and enforcement circumstances beyond our control.

7.2 Professional Judgment

Case strategy and procedural decisions reflect our professional judgment based on available information and legal requirements. While we seek client input on significant matters, we retain discretion over tactical choices necessary for competent representation.

7.3 Third-Party Actions

We are not responsible for debtor conduct, court scheduling delays, third-party service provider performance, or changes in applicable laws affecting case outcomes. Our obligation is competent representation within the legal framework, not control over external factors.

8. Limitation of Liability

To the maximum extent permitted under Thai law, Claimora's liability for any claims arising from representation is limited to the amount of fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or punitive damages including lost profits, business interruption, or opportunity costs.

This limitation does not apply to liability arising from willful misconduct or gross negligence. Professional liability insurance covers claims within policy limits for errors or omissions in professional services.

9. Client Indemnification

Clients agree to indemnify and hold harmless Claimora from claims, damages, or expenses arising from false information provided to our practice, client violations of debtor rights or applicable laws, use of our services for fraudulent or illegal purposes, or client breach of these Terms or service agreements. This indemnification includes legal fees incurred defending against such claims.

10. Termination

10.1 Client Termination Rights

Clients may terminate representation at any time by written notice. Upon termination, client remains responsible for fees earned to termination date, outstanding expenses incurred, and final billing for services rendered.

10.2 Practice Termination Rights

We reserve the right to withdraw from representation upon reasonable notice if client breaches material terms, fails to pay agreed fees, provides false information affecting case integrity, engages in conduct creating ethical conflicts, or if continuing representation would violate professional obligations.

10.3 Effects of Termination

Upon termination, we will transfer case files to client or successor counsel, complete urgent procedural matters to prevent client prejudice, and provide final accounting of fees and costs. Client obligations for payment survive termination.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms and all related service agreements are governed by the laws of Thailand. Any disputes arising from or relating to our representation shall be subject to the exclusive jurisdiction of Thai courts.

11.2 Informal Resolution

Before initiating formal proceedings, parties agree to attempt good-faith informal resolution of disputes through direct communication. Most concerns can be addressed through discussion of the specific issue and potential remedies.

11.3 Venue

Any litigation arising from these Terms or our services shall be commenced in Bangkok courts having appropriate jurisdiction. Both parties consent to personal jurisdiction and venue in such courts.

12. General Provisions

12.1 Entire Agreement

These Terms, together with executed service agreements, constitute the complete agreement between parties regarding subject matter covered. Oral representations or prior written communications not incorporated herein have no effect.

12.2 Severability

If any provision of these Terms is found unenforceable, remaining provisions continue in full effect. Unenforceable provisions will be modified to reflect parties' intent to the extent permissible under law.

12.3 Waiver

Failure to enforce any provision does not constitute waiver of that provision or right to enforce it subsequently. Waivers must be in writing to be effective.

12.4 Assignment

Clients may not assign or transfer rights or obligations under these Terms without prior written consent. We may assign these Terms to successor practices or in connection with practice reorganization.

12.5 Notices

All notices required under these Terms must be in writing and delivered via email to addresses provided in service agreements or to our office address listed below. Notices are deemed received upon email confirmation or three days after posting if sent by mail.

13. Changes to Terms

We may update these Terms periodically to reflect changes in our practice, legal requirements, or service offerings. Updated Terms will be posted on our website with revised effective date. Material changes affecting ongoing representations will be communicated directly to active clients.

Continued use of our services following Terms updates constitutes acceptance of revised provisions. If you disagree with updated Terms, you may terminate representation as outlined in Section 10.
